Terms and Conditions

By using the services provided by HomeCare Collective LLC ("we", "us", "our"), you ("Client", "you", "your") agree to the following Terms and Conditions. Please read these terms carefully before engaging our services.

1. Services Provided

We offer professional handyman services as outlined in the service agreement or description provided to the Client. These services may include but are not limited to, repairs, installations, and general maintenance.

2. Payment Terms

The Client agrees to pay the agreed-upon amount for the services rendered. Membership payment is a reoccurring expense that will continue until the client notifies us that they would like to cancel services. Emergency Service fee is due upon client agreement for the service call out to be performed. Service Payments are due upon completion of the service or as otherwise stipulated in the agreement. Large projects make incur a deposit that will be applied to the balance.

Membership Refund Policy:
Monthly Membership - Monthly membership fees will not be eligible for pro-rated refunds. Client must cancel membership prior to upcoming month.
Annual Membership - Pro-rated cancellations will be available. Annual fee will be prorated for total 12 month period. Ex. $1000 Annual Fee/ 12 months = $83.33 for each unused month.

3. Liability Limitation

To the maximum extent permitted by law, HomeCare Collective's liability for any claims, damages, or losses arising out of the services provided will be strictly limited to a refund of the amount the Client originally paid for the specific service in question.

  • This limitation applies regardless of the cause of the claim (whether arising from negligence, breach of contract, or any other legal theory).

  • The Client acknowledges that this is the sole and exclusive remedy available in the event of dissatisfaction or damage caused by the service.

4. Service Satisfaction

We strive to provide high-quality work, and your satisfaction is important to us. If the Client is dissatisfied with the service, they must notify us in writing within 90 days from the completion of the service. We will make reasonable efforts to address concerns and may offer a rework of the service, but the total liability remains limited to the original payment.

5. No Warranty Beyond Services Rendered

HomeCare Collective does not provide any express or implied warranties beyond the services rendered. We make no representations regarding the future performance, condition, or life expectancy of materials, repairs, or installations completed as part of the service.

6. Indemnification

The Client agrees to indemnify and hold harmless HomeCare Collective, its employees, agents, and contractors from any and all claims, losses, or damages arising out of or related to the service provided, except for damages directly caused by HomeCare Collectives's negligence or willful misconduct.

7. Force Majeure

We shall not be liable for any delay or failure in the performance of our obligations under these Terms and Conditions due to causes beyond our reasonable control, including but not limited to, acts of God, labor disputes, governmental actions, or failure of suppliers.

8. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any disputes arising out of or in connection with these Terms and Conditions shall be resolved through mediation in Harrisonburg,VA, and the Client agrees to bear their own costs and legal fees unless otherwise determined.

9. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

10. Amendments

HomeCare Collective LLC reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to the Client before service is provided, and the updated Terms and Conditions will apply to all subsequent services.
